When a student is accused of harassing or victimizing another student or staff, schools are often at the center of the resulting investigation, as well as any discipline or criminal penalties that result.  Many federal and state legal concepts are implicated in these complex fact scenarios:  Title IX investigation requirements, privacy of education records, public records laws, due process, potential tort claims, anti-bullying laws, to name a few.  The practical concerns are sometimes equally important, including how and when to discuss the investigation and its results with parents, how and when to separate students, and how to direct and train staff to deal with these situations.  A school attorney well-versed in these tricky situations offers a review of applicable law, and practical advice.
